Access Burke County Court Case Records

Start at the clerk's counter. Burke County court case records live with the Clerk of Superior Court, whose office keeps the files for Superior, State, and Juvenile cases, while Magistrate, Probate, and the municipal courts each hold their own. Before you request anything, pin down the court and the exact case. A good request names the document you want, its filed or entered date, the type of copy, and how you want it delivered. Know that an online docket entry may list an event without showing the paper behind it, so the file itself is what you need. Copy and certification fees apply, and lawful redaction or sealing can limit what a docket search returns.

Burke County Court Record Requests

Begin with the Burke Case Management Search. Write down the court, case number, document label, and date. PeachCourt may serve as the provider for State and Superior images. For official copies, go through the clerk who maintains the file. The unified office takes questions in person. It also answers by phone at 706-554-2279, by fax at 706-554-7887, by email at clerkofcourtservices.burke@gsccca.org, or by mail at PO Box 803, Waynesboro, GA 30830. Magistrate records use 706-554-4281, and Probate questions go to 706-554-3000. Municipal files belong to the city clerk. A narrow request under the Georgia Open Records Act can ask for an existing public record. It must be specific. A general county request, though, does not automatically reach a court file.

  1. Identify the court, case number, record, and filed date.
  2. Check the local docket or PeachCourt for an available image.
  3. Contact the correct clerk by counter, phone, mail, fax, or email.
  4. State whether inspection, paper, electronic, certified, or exemplified copy is needed.
  5. Confirm the current fee and payment method before sending money.
  6. Ask for a redacted public portion if some content is protected.

Burke Request Field Checklist

The Burke clerk publishes no certified-copy request form. So build your own written request. Include your contact information, the court, the exact case number, the document title or event, the filed date, the copy type, and your delivery choice. Ask about total fees too. It also helps to state up front that a lawfully redacted copy is acceptable.

FieldWhat to provide
CaseCourt and exact case number
RecordDocument label and filed or entered date
CopyInspection, plain, certified, exemplified, or transcript
DeliveryPickup, mail, email, or provider account if accepted

Hold off on sending sensitive identity data. Wait until the clerk confirms it is required and offers a secure way to submit it.

Kinds of Court Records

The docket is just the chronological index. The file itself may hold a complaint, summons, return, accusation, indictment, motion, response, or order. It can also carry a judgment, exhibit, transcript, payment record, or certified disposition. Keep Burke County record sources straight. GSCCCA handles deeds, liens, and plats, not the full case file. PCIS supports Probate functions. But that alone does not mean every local Probate image is searchable there.

  • Docket or register of actions
  • Pleadings, charges, motions, and responses
  • Summons, service, return, and warrant records
  • Orders, judgments, dispositions, and sentences
  • Transcripts, exhibits, and appeal records where public
  • Certified, exemplified, plain, paper, or electronic copies

Burke Docket Versus Document

A docket line proves an event was entered. It proves nothing more. It may not show the legal terms inside the filed document. A judgment entry can omit the award. It can also omit the duties it imposes. A motion entry does not mean the judge granted it. When the contents matter, request the signed and entered order itself. PeachCourt can work as a provider route for State and Superior images. Meanwhile, the clerk counter handles inspection and certified copies. GSCCCA land records and PCIS Probate information serve narrower purposes.

Court Records: What They Contain

Your request has to separate the index entry from the filed item. Capture the docket label and date, then name the actual motion, order, judgment, or transcript. Be careful with printouts. A screen print is not automatically certified. And a vendor receipt says nothing about what the court file actually contains.

Federal Records Use Augusta

Federal cases follow a different map. Burke County sits in the Southern District of Georgia. Its federal dockets never appear in the county portal. PACER and CM/ECF serve those cases. The Augusta federal clerk at 600 James Brown Boulevard issues official copies at 706-849-4400. PACER pricing lists $0.10 per page, a $3 cap for most documents, and a $30 quarterly waiver threshold. Opinions and courthouse-terminal access are free. Treat a free CourtListener or RECAP lead as a starting point. Then verify it against PACER.

The Southern District site identifies the federal court that covers Burke County.

Copy Fees and Certification

Know your copy types before you order. A plain copy simply reproduces the record. A certified copy carries the clerk's authentication, and an exemplified copy adds authentication for special uses. Ask the receiving office which one it requires. Burke's current county menu links a July 2024 fee schedule, and an older readable schedule still supplies historical figures that need confirming.

Current Burke Fees Need Checking

The county currently links a five-page schedule dated July 1, 2024. Its amounts need confirming, so treat any older figures as reference points only. No current docket-search, electronic-image, rush, or transcript fee is published. No copy turnaround is promised either. Always ask for the total before sending funds. Citation payment methods prove nothing about what the clerk accepts for general record copies.

PACER and CM/ECF Boundaries

Southern District CM/ECF is a restricted filing system for registered users. PACER is the public federal docket service. A county Open Records request cannot pull a federal docket, and a PACER print is not a certified federal copy.

The Southern District CM/ECF notice shows the restricted filing interface.

Access Rules for Court Records

Uniform Superior Court Rule 21 sets the baseline for court records. Rule 21.6 adds rules for protected identifiers. Expect extra review for juvenile, sealed, victim, minor, medical, financial, guardianship, and protected-person material. Public status does not promise free online images.

Start a Burke County request with the right office. Radeta G. Smith's unified clerk holds Superior, State, and Juvenile files. Reach the office by phone 706-554-2279, fax 706-554-7887, email clerkofcourtservices.burke@gsccca.org, the Judicial Center counter, or PO Box 803. Magistrate records sit in a separate office at 706-554-4281. Probate questions go to 706-554-3000. Municipal records stay with the city clerk. PeachCourt offers account-based access to State and Superior documents. For certification, go through the clerk who maintains the record. Do not route through any provider or payment channel.

Say exactly what you want. Ask for inspection, an electronic image, a paper copy, a certified copy, an exemplified record, or a transcript. Give the court, the exact case number, the document title, the docket label, and the filed or entered date. Ask about the current price and payment method before you send money. The readable fee values are historical, so the July 2024 county schedule controls. The clerk posts no ordinary copy turnaround, no rush fee, and no Burke online certified-copy form. When part of a record is protected, request the public docket index plus a redacted version. The Georgia Open Records Act cannot break a seal. It cannot force a clerk to build a new report either.

Request the public part.

Ask whether the whole file, one document, or only identifiers are restricted.

Request the legal basis and any available redacted docket or copy.

An Open Records request cannot override a sealing order.
